2. COLLECTION AND USE OF INFORMATION
We may collect Personal Information from you (whether you act as the contact person for a business or in your own individual capacity) when you:
(1) when you provide such information directly to us,
(2) passively through technology such as “cookies.”, and/or
(3) when we obtain information about you from third parties or our indexing systems.
Personal Information does not include information that has been aggregated or made anonymous such that it can no longer be reasonably associated with a specific person. Personal Information we collect may include:

We receive and store any information you knowingly provide to us. We collect Personal Information you submit to us, for example by completing the sign-up form on www.closedwon.ai. In that case, we may communicate with you, for example by calling you at the phone number you provide, sending you promotional email offers, or emailing you about your use of the Services. In keeping with standard online privacy practices, users should not include highly sensitive information (such as social security numbers and financial information) in any emails so that such data does not transfer to our servers, even if only temporarily. If you do not want to receive communications from us, please indicate your preference by sending an email to email@example.com.
Whenever you interact with our Site or Services, we automatically receive and record information on our server logs from your browser or device. These may include your IP (Internet Protocol) address, “cookie” information, the type of browser you are using, the type of device you are using, and the page or feature you requested.
Your IP address is automatically assigned to your computer by your Internet Service Provider. An IP address, along with the time of the visit and pages visited, may be identified and logged automatically in our server log files whenever a user accesses the Site. IP addresses for are used for purposes such as calculating usage levels, diagnosing server problems and administering the Services. Your IP address may also show your approximate geographical location.
Cookies are a feature of web browser software that allows web servers to recognise the computer used to access a website. Service Providers: We work with third party service providers to perform tasks on our behalf and need to share your information with them, in some cases these include the Personal Information you have provided to us, in order to make the Services available to you. Some examples are those that provide services such as website hosting, data analysis, payment processing, order fulfilment, information technology and related infrastructure provision, customer service, email delivery, auditing and other services. ClosedWon® maintains contracts with these third parties to restrict their access and use and disclosure of Personal Information.
Business Transfers: If we are involved in a reorganisation, merger, acquisition or sale of our assets, bankruptcy, or other similar events, any information in our possession may be transferred to our successor or assign.
When you visit our Site and/or register to ClosedWon®, you may opt-in/opt-out to certain web features such as cookies and email marketing. We may occasionally email you with information about offers or new services. You can opt-out of these email marketing communications, at any time, via an unsubscribe link included in such communications, or by sending an email to the address provided in the Contact Us section. If we are processing your Personal Information based on your consent (as indicated at the time of collection of such data), you have the right to withdraw your consent at any time by sending an email to the address provided in the Contact Us section.
If you are registered with ClosedWon®, you will continue to receive administrative email communications regarding the Service.
ClosedWon® will use very diligent efforts to protect the privacy of your account and other Personal Information we hold in our records, but unfortunately, we cannot guarantee complete security. We maintain reasonable administrative, technical, and physical procedures to protect information stored in our servers, which are located primarily in the United States. Unauthorised entry or use, hardware or software failure, and other factors, may compromise the security of user information at any time.
The Site and Services are controlled and operated by us from the United States. Your Personal Information may be stored and processed in any country where we have facilities or in which we engage service providers, and by using the Site and Services you consent to the transfer of information to countries outside of your country of residence, including the United States, which may have data protection rules that are different from those of your country. In certain circumstances, courts, law enforcement agencies, regulatory agencies or security authorities in those other countries may be entitled to access your Personal Information. ClosedWon® is responsible for the processing of the Personal Information it receives, under the Privacy Shield Framework, and for any data transferred to a third party provider. We comply with the Privacy Shield Principles for all onward transfer of Personal Information, including the onward transfer liability provisions. We maintain reasonable and appropriate security measures to protect Personal Information from loss, misuse, unauthorised access, disclosure, alteration or destruction, taking into account the nature of the Personal Information and the risks inherent in processing that Personal Information.
You have certain rights to access, correct, amend, or delete Personal Information where it is inaccurate, or has been processed in violation of the Privacy Shield Principles, except where the burden or expense of providing access would be disproportionate to the risks to the individual’s privacy in the case in question, or where the rights of persons other than the individual would be violated.
Following the dispute resolution process, you may refer the matter to the U.S. Federal Trade Commission, which has Privacy Shield investigatory and enforcement powers over ClosedWon®. Under certain circumstances, you may also be able to invoke binding arbitration to address complaints about ClosedWon® with the Privacy Shield Principles.
California law permits California residents to request and obtain from us once a year a list of the third parties to whom we have disclosed your Personal Information (if any) for direct marketing purposes in the prior calendar year, as well as the type of Personal Information disclosed to those third parties, free of charge. ClosedWon® do not share Personal Information with third parties for their own direct marketing purposes without your prior consent. Accordingly, you can prevent disclosure of your Personal Information to third parties for their direct marketing purposes by withholding consent.
The General Data Protection Regulation (“GDPR”), effective as of 25 May 2018, strengthens data protection for European Union (“EU”) individuals’ personal data. The GDPR ensures to govern the processing and storage of EU individuals’ data based on privacy by design and taking a risk-based approach. Closedwon® is well aware of its role in ensuring the security and protection of the personal data that we process.
We aim to show transparency by providing a compliant and consistent approach to data protection. We are dedicated to adhering fully with GDPR and have implemented strong privacy protections that reflect the new legislation. Further sections of this document offer more detail regarding our commitment to GDPR.
It is expected of our Customers to abide to applicable rules and regulations, including the GDPR. Compliance is a shared responsibility with our Customers (data controllers) and us (data processors). It is the Customer’s responsibility to collect, process and transmit data in compliance with applicable laws, including the GDPR. It is our responsibility to comply with the terms of our data processing agreement with the data controller, specifying how it can process personal data on the data controller’s behalf. ClosedWon® offers a Data Processing Agreement to Customers outlining the terms of agreement with regard to the Processing of Personal Data.
ClosedWon® only processes professional data, regardless of geographical location, such as name and employer.
We respect your privacy and therefore we have expanded individuals’ rights by enabling Customers to request their personal data. These are as follows:
In the event of a breach, ClosedWon® will notify our Customers within 72 hours of first having become aware of the breach, where feasible.
